1. GENERAL

These terms and conditions, together with any other written information brought to your attention before we confirm your booking, shall form the basis of your contract with Highland Explorer Ltd (a company incorporated in Scotland No: SC698415). Please read these terms and conditions carefully and contact us if you have any queries. ‘We’ or ‘Us’ refers to the company Highland Explorer Ltd.

Within these conditions, ‘You’ and ‘Your’ means all persons named on the booking. When making a booking, the ‘lead client’ specified in the booking will be deemed to have accepted these conditions on behalf of all passengers named within the booking. All bookings will only be confirmed when made in writing and this includes by e mail.

We will make every effort to ensure that the information and prices in any of our marketing materials and on our website are accurate; however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You should check the current price and all other details relating to the arrangements that you wish to book before your booking request is made. All tours are sold subject to availability.

2. BOOKING PROCESS

Bookings can be made either through the website and by e mail, over the phone and in person. For all Highland Explorer services, either full payment or partial payment is required on booking. Once payment has been received, then the booking will be confirmed. We also operate a discount policy for clients who pay in full at the time of booking. The booking process for our various services are explained below:

  1. Transport – clients should confirm their transport requirements in advance to ensure that we have available transport on the dates required. This is only relevant for groups who require multi-day transfers, such as golf groups for airport pick-ups, drop-offs and transfers to golf clubs.

Full Payment at time of booking – 10% discount on total booking. OR

Deposit Payment at time of booking – 20% deposit when making the booking, with balance of payment 14 days prior to the first day of transport.

  1. Tours – clients should confirm their Tour requirements and itinerary in advance, to ensure that we have availability on the date/s required.

Deposit Payment at time of booking – 20% deposit when making the booking, with balance of payment 14 days prior to the day of the Tour.

  1. Multi-Day Tours – we offer multi-day tours across Scotland. We provide vehicle and experienced driver/guide (Highland Explorer driver/guide will remain with the group throughout the Multi-Day Tour) but we also assist lead clients with designing a full itinerary, advising on accommodation options, attractions and food and drink venues. However lead clients will have to book their own accommodation.

Full Payment at time of booking – 10% discount on multi-day tour. OR

Deposit Payment at time of booking – 20% deposit when making the booking, with balance of payment 14 days prior to the first day of the Tour.

  1. Activities and Experiences – we conduct and arrange various activities that include walks, bike rides, fishing and shooting. We advise a good lead time when booking fishing and shooting experiences. Once we receive an enquiry, we will make arrangements for the activity and once availability is confirmed we will inform the client. If the client is happy with the details of the activity and cost, we will then ask for payment as follows:
  • Fishing – fishing requires pre booking of fishing permits for either Lochs or Rivers and often with boats. Fishing permit prices for salmon fishing can be expensive.

Full Payment at time of booking – no discount given. OR

Deposit Payment at time of booking – covers the full cost of fishing permits and/or boat hire which is non-refundable. Balance of payment which includes fishing guide and fishing equipment, 14 days prior to the day of fishing.

  • Shooting – deer hunting and bird shooting can be arranged with local sporting estates. Terms and conditions will vary from estate to estate and will be notified to the client before any booking is confirmed.
  • Biking – clients wishing to take part in a guided on and off-road ride, will have to submit a British Cycling ‘Rider Consent Form’. This gives the qualified Cycling Guide relevant information regarding the client’s previous cycling experience, as well as medical history and any conditions that might affect a rider during the ride.

Full Payment at time of booking – no discount given. OR

Deposit Payment at time of booking – for the cost of the hire of the bikes only. Balance of payment for the guide services, 14 days prior to the day of the ride.

  • Walks – for clients who seek a challenging level of walk, we can arrange for a qualified SML guide to lead and guide the walk. However for lower level walks in scenic and nature areas, we can offer a guide without SML but who has broad outdoor experience and accreditation, including Level 2 Mountain Bike Leader and Outdoor First Aid. As for Biking, we require clients to submit information on fitness level, previous walking experience and medical history including any conditions that might affect them during the walk.

Full Payment at time of booking – no discount given. OR

Deposit Payment at time of booking – 20% at the time of booking. Balance of payment 14 days prior to the walk.

3. CHANGES BY US

In the unlikely event that we are required to significantly alter a material part of your tour or activity, we will notify you of this as quickly as possible in order to enable you to decide how you wish to proceed. In such event you will be entitled:

  1. To take an alternative tour or activity of equivalent or superior quality, if we are able to offer that, or
  2. To take a substitute tour/activity of lower quality if we are able to offer that (in which event the  difference in price between the original and the substitute tour/activity will be refunded to you); or
  3. To cancel your booking and obtain a full refund of all monies paid by you.

Please be aware that the nature of travel involves risks and unpredictable weather and road conditions and we cannot, therefore, guarantee that a tour or activity can be conducted as planned.

4. CHANGES BY YOU

If you wish to change any part of your confirmed booking, you should inform us in writing as soon as possible. This should be done by the lead client named on the booking. Whilst we will do our best to assist you, we cannot guarantee that we will be able to meet your request.

Where we agree a change request made by you, any changes made may be subject to an administration fee. In addition, you may also be required to meet any extra costs incurred by us (and any costs or charges incurred or imposed by any of our partners) in making the requested change. Where we are unable to meet your change request and you no longer wish to travel on the basis of the original booking, this will be treated as a cancellation of your booking and cancellation charges may be payable by you, as outlined in these terms.

5. CANCELLATION POLICY

The cancellation policy if clients cancel our services are as follows:

  1. Transport – more than 7 days full refund – less than 7 days, 80% refund.
  2. Tours – more than 7 days full refund – less than 7 days, 80% refund.
  3. Multi-Day Tours – more than 14 days full refund – less than 14 days, 80% refund.
  4. Activities – as follows:
  • Fishing – fishing permits/boats non-refundable. Less than 7 days no refund.
  • Deer Hunting and Bird Shooting – each estate has different terms and conditions. We will advise clients on relevant terms and conditions once availability is known.
  • Biking – more than 7 days full refund – less than 7 days full refund excluding bike hire costs.
  • Walks – more than 7 days full refund – less than 7 days, 80% refund..

6. CANCELLATION DUE TO COVID

In the event that either we or the client needs to cancel a booking, due to covid safety measures imposed by either country of origin or in the UK and Scotland, then clients will have a choice as follows:

  1. To accept a full refund of all costs paid to Highland Explorer Ltd OR:
  2. To keep the booking for a further one year from the original booking date.

7. FORCE MAJEURE

Unless expressly stated otherwise in these terms and conditions, we will not accept any liability to you if we are prevented from fulfilling our contractual obligations to you as a result of any event which is out with our control (and/or out with the control of our partners for the service in question). Such events may include (but are not limited to) war or threat of war; terrorist activity or the threat of terrorist activity; civil commotion or riot; any action taken by a governmental or public authority; industrial disputes; collapse of buildings, fire, explosion or accident; traffic or road conditions or road closures; technical or mechanical breakdown; adverse weather conditions; natural disasters and all similar events or circumstances.

8. DISABILITIES AND MEDICAL PROBLEMS

We will try to accommodate disabilities and medical problems where we can but please be aware that many of our tours and activities may not be suitable. If you or any member of your party has any disability or medical problem which may affect their ability to travel on one of our Tours or on one of our Activities, then please provide us with full details at the time of making your booking enquiry, so that we can advise you as to the suitability of your chosen arrangements. If we are not informed of any disabilities or medical problems in this way, then we cannot be held responsible for any cost or inconvenience incurred if we are unable to accommodate you or any member of your party.

9. CHILDREN

Any children up to the age of 15, booked on to any of our Tours or Activities, must be accompanied by an adult. We provide basic child seats for small children but we would advise that clients with small children bring their own child seats, fitted to the size of their child. Please enquire about this at the time of booking.

10. LUGGAGE

Our vehicles have plenty of boot capacity for luggage. However groups with excess luggage and/or large golf travel bags, should inform us at the time of booking, so that we can arrange a trailer to carry the additional load.

11. SMOKING AND EATING IN VEHICLES

Smoking or eating in any of our vehicles is not permitted.

10 . TRAVEL INSURANCE

We strongly recommend that all clients arrange suitable travel and medical insurance, to protect themselves while on holiday in Scotland.
